That butterflies in the stomach feeling?

That is not quite the feeling that working on a legal writing assignment gives me. More like little hamsters gnawing at my insides. Sick. I know what my problem is. I research and reread everything and second guess myself until I feel like I don't know anything at all. That leads to mental paralysis as I stare at the screen thinking...this could go either way. Actually in this case our imaginary client is screwed, so we're trying to argue that the law screwing him isn't Constitutional. It's a losing argument, and isn't really all that fun to write.

If I were smart I would pretend that I was writing a closed-universe brief, and that I could only work with the handful of cases I currently have up on my screen. I'd make the best argument I could using those cases. My fingers would start moving again. Let's see if I can put that into practice.

Yet, you are smart because the universe will be open in the real world. But it will be Alito's universe...maybe we should just focus on what we have. Findings, findings, findings...machineguns, machineguns, machineguns. ehehehehe! (machinegun noise)
